On July 31, 2024, the new pay transparency and wage reporting regulations for specific employers with staff members in Massachusetts was signed into law. This legislation mandates that employers with 25 or more employees in the Commonwealth include pay range information in their job postings and provide pay range details to current employees under certain conditions.
The law will be effective starting July 31, 2025 and is enforced through the Attorney General’s office. Covered employers must post the “pay range” (annual salary range or hourly wage range) for a particular position on all job postings; make employees who are offered a new position in the Company with different job responsibilities aware of the pay range; inform any existing employee holding the position the pay range for their position upon request; tell an applicant for employment about the pay range if they request that information. Massachusetts’ employers are not required to disclose bonuses or other benefits.
Employees have rights regarding the pay transparency law that are comparable to their protections under other employment laws (i.e., no retaliation against employee if they take action to enforce their rights under the law).
